Mohamed Alli Chicktay

Professional background and experience:

Dr. Mohamed Alli Chicktay is a tenured law academic at the University of the Witwatersrand, a mediator and chairperson of the Companies Tribunal. He also serves as a commissioner of the Broadcasting Complaints Commission of South Africa (BCCSA). Mohamed is a practising mediator and arbitrator in labour law, commercial law, property and land disputes and has worked professionally for the Commission for Conciliation, Mediation and Arbitration (CCMA) and several Bargaining Councils. He has also worked as a mediator with the Harvard Mediation Program. Over the past twenty years, Mohamed has chaired disciplinary hearings, conducted arbitrations and lectured law at Wits Law School in both the LLB and LLM programmes. Alongside his teaching and dispute resolution work, he has published widely in accredited South African and international law journals and presented conference papers in India, Malaysia, Greece, England and South Africa. 

He also provides mediation and arbitration training to prospective CCMA commissioners undertaking the Labour Dispute Resolution Programme at the University of the Witwatersrand. Mohamed holds an LLB, LLM and PhD from the University of the Witwatersrand in Johannesburg and completed studies in negotiation and mediation at Harvard Law School.

Mediation experience and style:

Mohamed is accredited mediator with the Centre for Effective Dispute Resolution. His work in dispute resolution also extends to scholarship and he has published and contributed to several books on dispute resolution and labour law. He has provided mediation and arbitration training to legal professionals, judges, academics and parliamentarians from Kenya, Uganda, Nigeria, Botswana, Malawi, Tanzania, Zambia and South Africa. He has also assisted in preparing mediators involved in Lesotho’s High Court annexed mediation procedures. Mohamed regularly delivers training lectures in mediation and arbitration skills for the CCMA practical commissioner course as well as the mediation course offered by the University of the Witwatersrand. He currently acts as a mediator and adjudicator for the Community Schemes Ombud Service (CSOS) and the Companies Tribunal.

Facilitation experience and style:

Mohamed has facilitated wage negotiations and recognition agreements. In his role as chairperson of the Companies Tribunal, he facilitated tribunal meetings and managed processes involving mediation, arbitration and adjudication. Within the University of the Witwatersrand, he has also taken on several leadership roles, including serving as academic director of the International Human Rights Exchange Program and as chairperson of the Law School Teaching and Learning Committee.

Chairing enquiries and investigations experience:

Mohamed has more than twenty years’ experience chairing disciplinary hearings and conducting arbitrations. He has served as a commissioner for the CCMA, the Education Labour Relations Council (ELRC) and the Metal and Engineering Industries Bargaining Council (MEIBC). He has also chaired private disciplinary hearings and private arbitrations.
